persistent rumor out there, true or false, that if a LL acknowledges and
accepts the occupancy of a subtenant then it legitimatizes the
subtenant’s tenancy and a smart lawyer can argue that the LL has
elevated the subtenant into the status of a co-tenant.

The SFAA
recommends that all LL keep a long distance between themselves and the
subtenants, even going so far as to never have direct contact between LL
and subtenants, recommending that all communication should be between
LL and tenants only.

It’s obvious that the LL is, rightly or
wrongly, afraid of the risk involved with dealing directly with a
subtenant and is much more comfortable negotiating when the tenancy ends
and the subtenant turns into just another person off the street trying
to rent a place. I’d suggest the subtenant uses the tenant as a
go-between and inquire about the rental price, that could put the LL
more at ease since LL is not dealing with subtenant. Subtenant can get
information from the LL, but it’s still apparent that the LL will only
negotiate with subtenants after the tenancy ends.
