12:18 PM: San Francisco 49ers linebacker Aldon Smith was arrested in San Jose this morning on suspicion of driving under the influence of alcohol and possession of marijuana, police and Santa Clara County sheriff’s officials said.
Smith, 23, was arrested at about 7 a.m. after a solo-vehicle crash on Bentley Ridge Drive, San Jose police spokeswoman Sgt. Heather Randol said.
Randol said someone called 911 to report a vehicle striking a tree.
Smith was not injured in the crash and was arrested shortly afterward, Randol said. She said no one else was in the vehicle and that Smith was cooperative with police.
Smith was booked into county jail on suspicion of DUI as well as the marijuana offense, sheriff’s spokesman Sgt. Kurtis Stenderup said.
He was released later in the morning after posting $5,200 bail, Stenderup said.
The arrest is the latest legal problem for the star linebacker, who is facing two separate civil lawsuits filed by people who said they were shot at a party he held at his home near San Jose last year.
Smith has 3.5 sacks through the first two games of the 2013 season for the 49ers, who are 1-1 and host the Indianapolis Colts at Candlestick Park in San Francisco on Sunday afternoon.
The team released a statement this morning regarding the arrest.
“The 49ers organization is aware of the matter involving Aldon Smith. As we continue to gather information regarding this situation, we will have no further comment,” the team said in the statement.
