I need to clarify my statement that the reader is not a master tenant.

You are correct, the reader is a master tenant in that he sublet the apartment to John. He is not, however, an original occupant. None of the current tenants are original occupants. Given that information, a court could find that the reader has no standing to evict the subtenant because all of the tenants have equal status.

It seems crazy for the law to create a situation where people live together while in a state of conflict, but neither is willing to give it up. That’s bound to end in unpleasantness, or worse.

Tenants who abuse the system like this only give rent control a bad name. Ok, the landlord is clearly not paying attention, and is hardly blameless. But rent control brings quite a few unpleasantness from spoiled entitled tenants. The letter writer should move out, make sure the landlord is aware that he was the last original tenant on the lease, so that both he and John get the rent increase their brat behavior deserves.
